Terms and Conditions
By completing payment and accessing the full Business Stress Test Report (Report), you (User) agree to be bound by these Terms and Conditions (Terms). Please read them carefully:
1. Service Description
The Report provides a risk score and business risk profile based on User's responses to the assessment questions. It is for informational and educational purposes only and should not replace professional advice. We make no guarantees about accuracy, completeness, or results from following recommendations. Business risks involve inherent uncertainties.
2. Payment and Access
Payment is required to access the Report. User must provide accurate payment info. Your payment grants a non-exclusive, non-transferable license to view and use the Report for your business only. The Report is delivered digitally (PDF/email) immediately upon payment confirmation. No refunds or exchanges. All sales are final due to the personalized nature of the Report.
3. Intellectual Property
The assessment questions, Report, scoring methodology and business profiles are all proprietary to Gaenity Inc. Users don't acquire ownership rights. You may not copy, distribute, reproduce, modify, sell, or share the Report with third parties without written permission. Personal use only; no resale, republishing, or use in consulting/advisory services.
4. Use of Information
User's responses and Report will be kept confidential. Gaenity Inc won't sell or share User data without consent, except to the extent permitted by law.
5. Disclaimer
The Report isn't a substitute for professional advice. User is responsible for assessing and addressing business risks.
6. Limitation of Liability
Gaenity Inc is not liable for any direct, indirect, incidental, or consequential damages arising from use of the report or completion of the business stress test, to the fullest extent permitted by applicable law. Total liability shall not exceed the amount you paid for the Report.
7. Privacy
Your data is handled per our Privacy Notice. Payment info is processed securely via [Stripe/PayPal/etc.] and not stored by us.
8. Termination
Gaenity Inc reserves the right to terminate access to the Report if Terms are breached.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of Ontario, Canada and the federal laws of Canada. Any disputes will be resolved through arbitration in accordance with the Arbitration Act (Ontario), Canada, as amended.
10. Dispute Resolution
Disputes will be resolved through binding arbitration in Ontario, Canada, with one arbitrator appointed by the parties. The arbitration will be conducted in English. Users outside Canada may participate remotely.
10. International Users
Users accessing the Report from outside Canada are responsible for complying with local laws and regulations.
11. Entire Agreement
These Terms constitute the entire agreement between User and Gaenity Inc. By checking the box below, you confirm you've read, understood, authorized to bind your business, and agree to these Terms.
